On Thursday, an Enugu State High Court ruled that the proscription of the Indigenous People of Biafra by the South-East Governors’ Forum was declared illegal, unconstitutional, and null and void. This move took place in 2017 when the South-East Governors Forum, headed by former Governor David Umahi of Ebonyi State, banned IPOB and its operations, subsequently causing the federal government to designate the self-determination group as ‘terrorists.’ Nevertheless, Nnamdi Kanu, the leader of IPOB, pursued a legal course through his attorney, Mr. Aloy Ejimakor, to request the reversal of the proscription. Kanu petitioned the court to affirm that the proscription of IPOB was unlawful due to its status as an organization, “composed of citizens of Nigeria of the Igbo and other eastern Nigerian ethnic groups, professing the political opinion of self-determination.” Kanu requested the court to pronounce his, “arrest and consequent detention and prosecution as illegal, unlawful, unconstitutional and amounts to infringement of the applicant’s fundamental rights.” He implored the court to issue a declaration that, “self-determination is not a crime and thus cannot be used as a basis to arrest, detain and prosecute the applicant.” He subsequently requested the court to enforce that the defendants be obligated to compensate him with N8 billion in damages, “for the physical, mental, emotional and psychological trauma he was subjected to.” In his ruling delivered on Thursday, October 26, Justice Onovo concurred with Kanu’s argument and affirmed the proscription of IPOB, “unconstitutional and illegal.” The judge additionally mandated the federal government to award Kanu damages totaling N8 billion and to issue a public apology to him through newspaper advertisements. Speaking to the press shortly following the verdict, Barrister Ejimakor, the attorney representing Kanu, stated, “We are grateful that justice has prevailed over this matter since 2017. The court has reaffirmed the hopes of the common man in the judiciary. Nnamdi Kanu wins appeal court case against FG, discharged and quitt Kanu was prosecuted by the Federal Government at the Federal High Court in Abuja for 15 count charges bordering, including treasonable felony and terrorism, offences he denied. Kanu had faulted the order of Justice Binta Nyako of a Federal High Court, Abuja, which ordered him to answer seven out of the 15-count terrorism charge against him. He had prayed the appellate court to quash the entire charges and set him free on various grounds including that the purported offences were not committed in Nigeria. Kanu has repeatedly called for the breakaway of southern Nigeria to form the Republic of Biafra. On October 2015, he was arrested by Nigerian authorities on an 11-count charge bordering on “terrorism, treasonable felony, managing an unlawful society, publication of defamatory matter, illegal possession of firearms and improper importation of goods, among others.” He was granted bail on April 2017 for medical reasons. However, Kanu fled the country in September 2017 after an invasion of his home by the military in Afara-Ukwu, near Umuahia, Abia State. He was then sighted in Israel before relocating to London, UK. He has been under DSS detention since June 2021 when we was illegally captured in Kenya and brought to Nigeria. Delivering it's judgement on Thursday, October 13, a three-man panel of the Court of Appeal said the Federal High Court lacks the jurisdiction to try him in view of his abduction and extraordinary rendition to Nigeria in flagrant violation of the OAU convention and protocol on extradition. The court held that the 15-count charge preferred against Kanu did not disclose the place, date, time and nature of the alleged offences before being unlawfully extradited to Nigeria in clear violation of international treaties. The court also held that the Federal Government failed to disclose where Nnamdi Kanu was arrested despite the grave allegations of terrorism against him. There was tension in Orlu area of Imo State when some soldiers reportedly ordered traders to close shops for one week. Our correspondent gathered that the anger of the security agents stemmed from the fact that the traders chose not to open their shops on Monday as a result of the arraignment of IPOB leader, Nnamdi Kanu, in Abuja. Kanu was not arraigned as the Department of State Services (DSS) failed to produce him in court. One of the traders, who spoke to our correspondent on phone, said that the traders were mainly dealers on timber and building materials along Orlu - Owerri road. He said, "We went to the shop this morning and discovered that soldiers on patrol along the Orlu-Owerri Road near the building materials and timber markets in Orlu were not allowing us to open our shops. "They said we should go home for one week. When we asked them why, they said it's for absenting from our shops yesterday (Monday)." The killing of Omuma DPO and six men suspected to be members of IPOB is also generating tension in Owerri, the Imo state capital. They were killed when suspected IPOB members regrouped on Monday to launch attack on Omuma in Oru East local government area of the state before they were repelled. For most of Tuesday, heavily armed policemen were seen patrolling major streets in the metropolis and its environs. BACKGROUND On Wednesday, September 20, the Abuja Division of the Federal High Court issued an order declaring IPOB as a terrorist organisation. NEWS STORY In a statement, Mr. Kanu’s lawyer, Ifeanyi Ejiofor, said a motion challenging the court's order has been filed. Mr. Ejiofor argued that IPOB is a non-violent organisation; therefore the decision of the Abuja Division of the Federal High Court to issue an order, based on a motion made ex-parte, was illegal. A motion ex-parte is a motion heard by the court without the presence of the other party/ parties.
