Antioch hit with third federal lawsuit alleging police misconduct The suit, filed Thursday in U.S. District Court, names the city, individual current and former officers and three former police chiefs. “What I’m most concerned about is the pattern and practice that allows for this unconstitutional conduct to occur in the department,” said civil rights attorney John Burris. Burris’ clients in the latest suit are six men, one of whom was shot and wounded, and one woman, who says she was wrongfully detained and arrested. “It’s about the lack of respect. It’s allowing officers to engage in this kind of misogynistic, racial profiling, homophobic conduct, and that is what we’re trying to stop,” he said. Burris has previously filed two lawsuits against Antioch police on behalf of more than a dozen other plaintiffs. The new lawsuit, in addition to damages, attempts to hold the City of Antioch and its Chiefs of Police responsible for the harm caused to the Plaintiffs by the Police Department’s “Unconstitutional and Unconscionable race-based policing, racial profiling, and criminal conduct by Antioch police officers.” The legal action also asks the court for injunctive relief to “change the policies and procedures of the Antioch Police Department to bring the Department into Constitutional policing and best practices.” “Many Antioch police officers engaged in a pattern of despicable race, misogynists and excessive force policing that debased the safety and sensibility of the people of Antioch,” said Civil Rights Attorney John Burris. The police scandal in Antioch is growing again. A prominent Bay Area civil rights attorney says he’s filing a new lawsuit against the department on behalf of seven more clients. That’s in addition to the 13 he already represents. Robert Handa reports. The city of Antioch is now facing its third civil rights lawsuit following an investigation of its Police Department, and the plaintiffs’ attorneys say to expect additional suits to arise as they build a case aimed at reform and mandated oversight. “We’ve got a large group of victims, and there will be more,” said Ben Nisenbaum, a civil rights attorney with Burris, Nisenbaum, Curry & Lacy. Nisenbaum explained that the number of victims is now large enough that his firm can demonstrate a breadth of violations and move forward with a Monell claim, referring to the 1978 case of Monell v. Department of Social Services. In that case, the U.S. Supreme Court overturned Monroe v. Pape, dissolving immunity for public entities and holding them accountable for their employees’ actions. The end result they’re seeking, Nisenbaum said, is policy change through a negotiated settlement agreement (NSA), which would be overseen by a federal judge and enforce measures of reform as prescribed.
