The Pennsylvania legislature is an interesting example of what can happen in a swing state. The state Senate is mostly Republican with a six-seat majority while the House is majority Democrat with a two-seat majority. Which is why we can usually trust that if gun control is going to start somewhere and look to gain some steam, it’ll be in the House. But the majority is slim enough that some particularly egregious measures aren’t likely to get enough support as vulnerable Democrats decline to put their political careers at risk over some party position. That’s probably what happened when two gun control bills died in the House this week. The divisive issue of gun control brought a rally and two failed attempts at passing legislation on Tuesday to the Pennsylvania Capitol. A bill banning bump stocks and similar devices failed in a 101-100 vote in the Pennsylvania House on a near party-line vote that saw one Democrat, Rep. Frank Burns, D-Cambria County, side with Republicans in keeping the bill short by a single vote needed to pass. The same margin held for a bill that would require firearm dealers to report gun sales electronically. Both pieces of legislation could be brought up for reconsideration. “Look at the FBI crime statistics — actually putting criminals in jail is what works, not creating new crimes. Not by duplicating something that is already covered in federal law,” said Rep. Bryan Cutler during the debate over the bump stock bill. Much of the attention was focused on the bump stock bill, which died because, as Cutler said, it’s already illegal currently. Whether that holds or not is irrelevant here and now, and even if it doesn’t, we need to remember that bump stocks were used in only one crime that anyway can recall. Yes, it was a horrific one, but thousands of these things were in circulation before Las Vegas. They weren’t the problem. Continued ⬇️⬇️⬇️
Virginia congressman Bob Good is facing a tough primary fight in his bid for re-election, but he’s putting the powers of incumbency to good use ahead of the June 18th primary election in the 5th District. Good has introduced the Silencers Help Us Save Hearing (SHUSH) Act, which would remove the federal restrictions on purchasing or possessing suppressors. The measure that stands zero chance of being enacted into law with the Senate and the White House under Democratic control, but it is a way for Good to remind voters that he’s a Second Amendment supporter. “I oppose any form of regulation or tax on the people’s right to keep and bear arms. No constitutional right should be at risk due to public opinion, or subject to regulatory and tax burdens,” he said. “These rights certainly extend to the procurement of safety accessories for firearms. My legislation would eliminate the overly complicated and antiquated process for acquiring suppressors and ensure that those purchases are no longer subject to federal regulation.” He’s not wrong, even if the bill is more of a signal to Second Amendment supporters like myself than anything else. Suppressors are actually mandated in several European countries, and if they were easier to acquire here we’d probably see far fewer stories like this popping up. Some people living in Burgin, [Kentucky] are speaking out after they say a neighbor’s gun range has ruined their peace. Janet Dollar’s home sits right across the street from the gun range. “We purchased our home during the winter months, so we didn’t hear any gunfire during that time. As soon as springtime hit, it was nonstop. There were many mornings that we woke to cannons firing, multiple gunshots, round after round,” Dollar explained. While there’s been a whole lot of kvetching and whinging about so-called ghost guns, the truth of the matter is that they’re a small minority of the total number of firearms found in criminal hands. What’s more, the genie is out of the bottle on those. People who want to make their own guns illegally can and will because the information is out there. But California’s more urban areas—the places where the vast majority of the state’s gun grabbers reside and rule—still think they can stop bad people from doing bad things with a few laws. And when anyone tries to get around those laws, well, the get ornery about it, which is what led to a new lawsuit. The County of San Diego and national gun safety group GIFFORD Law Center have partnered on a lawsuit against Defense Distributed, a gun manufacturing company. The county claims the company did a bait and switch on an already banned product. “They are profiting on death and they need to be held accountable,” said county supervisor vice chair Terra Lawson-Remer. That’s not what “bait and switch” means. “Bait and switch” is when you’re offering a particular product at a low price as a means of getting someone into your store, only for the product to not be there. Instead, there’s a competing product available at a higher price. The goal is to get people to buy the more expensive item. That’s not what’s happening here. But the term “bait and switch” is pretty well known among people, but poorly understood. As such, they use it to make it seem like what Defense Distributed did is even more nefarious. With just two days left in the legislative session, one of the prime architects of a sweeping semi-auto ban that’s already been approved by the Colorado House says she’s asking for her bill to be killed in a Senate committee, even while vowing to revisit the ban in the future. Rep. Julie Gonzales’s decision has more to do with saving face than protecting the Second Amendment, given that the bill faced a tough vote in a key Senate committee and had been treated with skepticism by Gov. Jared Polis. Even if Gonzales had not asked for the bill to be killed, it was unclear if the measure could make it out of the Senate State, Military and Veterans Affairs Committee. Democrats have a 3-2 majority on the panel, but one of the three Democrats is Sen. Tom Sullivan, a Centennial lawmaker whose son was killed in the Aurora theater shooting. Sullivan is a fierce gun-regulation advocate but a skeptic of a so-called assault weapons ban in Colorado. “Banning? That doesn’t end well for us,” Sullivan, told The Washington Post last year. “And I’m speaking as the father of a son who was murdered by an assault weapon.” It was unclear if the bill had enough support to pass the full Senate. Gov. Jared Polis also said he is skeptical of the idea. “I’ve long been skeptical of discussions around ‘this kind of equipment versus that kind of equipment,’” the Democrat told The Sun in an interview earlier this year. “I think it’s more an issue of making sure our gun safety laws are followed. Many of the most popular handguns in the country could soon be illegal to sell in New York, after state Sen. Sen. Zellnor Myrie introduced a bill banning the manufacture and sale of “convertible pistols.” The bill was drafted with the help of Everytown, according to the Wall St. Journal, and it’s highly unlikely that New York will be the only state where the gun control lobby starts pushing for a semi-auto ban. Myrie said the legislation doesn’t name Glock, but he wrote the bill to address Glock pistols because they are easily convertible for machine gun-like fire. The converted guns increasingly have been used in crimes, he said. It’s already illegal under federal law to possess an auto-sear or machine gun conversion device, but with law enforcement around the country reporting a growing number of firearm recoveries where an auto-sear was attached, gun control groups like Everytown see this as an opportunity to go after the firearms and not just the illegal aftermarket accessory. Despite Myrie’s contention that other semi-automatic firearms not produced by Glock can’t be illegally converted to full-auto, the truth is the the vast majority of semi-automatic firearms can be converted into machine guns, so long as someone’s willing to put in the time and effort... as well as violate the law. It’s probably more fair to describe Myrie’s bill as a ban on most semi-automatic pistols. It’s also a little surprising that he didn’t choose to target all semi-automatic firearms, given that the gun control lobby has quietly been arguing for several years that most semi-automatics should be treated like they’re machine guns because of their convertability. Building your own firearm is something that’s happened on American shores since before this nation was this nation. People have bought parts they couldn’t fabricate and built everything else, making their own firearms and then using them. It was never a question. Then a few years ago, a lawmaker freaked out because it turned out people could still do this. It was a hobby supported by a cottage industry that few actually took part in. But when the media started going on and on about the dangers of it, well, criminals started taking notice. That was then used to justify restrictions on these homemade firearms. And then they were banned in many places. Following Bruen, I suspect those bans to be short-lived, but Colorado’s managed to dodge the proverbial bullet. A federal judge on Thursday rejected a request from gun rights advocates to block a recent Colorado law prohibiting the possession and transport of certain firearm components not imprinted with a serial number — known as “ghost guns.” ... In a May 2 order, U.S. District Court Judge Gordon P. Gallagher declined to issue a preliminary injunction, finding the plaintiffs did not have standing to challenge certain aspects of the law. Otherwise, he did not believe SB 279 even implicated the plaintiffs’ Second Amendment right to keep and bear arms. The law “imposes a condition on the commercial sale of a firearm,” Gallagher observed. It “does not prevent an individual from buying an unfinished frame or receiver or firearms part kit and in no way infringes upon Plaintiffs’ right to acquire arms. Rather, the Statute requires the purchaser to have the frame or receiver serialized.” Sen. Rhonda Fields, D-Aurora, who was one of SB 279’s sponsors, welcomed the decision. “No one should be able to produce an unregulated, unserialized gun in their home and basement. Our law says you go to a dealer, get a gun, with a background check, it’s serialized,” she said. “To undermine our process and federal standards gives license to people who want to do harm and do criminal activity with an unregistered gun. When the nine justices on the Supreme Court gather behind closed doors for their weekly conference on May 16th, two bans on so-called assault weapons will be among the cases they’ll be considering for acceptance. The Court has officially calendered Bianchi v. Brown, which is a challenge to Maryland’s ban on “assault weapons, as well as several affiliated lawsuits that are taking on Illinois’ ban on “assault weapons” and “large capacity” magazines, for distribution at its May 16th conference. That doesn’t guarantee that there’ll be four justices willing to grant cert to either challenge, but Second Amendment advocates are cautiously optimistic that one or both of the bans will face scrutiny by the Court this fall. Second Amendment Foundation founder and executive vice president Alan Gottlieb said he’s encouraged that the five cases have been distributed for the same conference, and believes it “could be the signal for which we have been waiting, that the Supreme Court may be ready to consider cases challenging bans on the most popular firearm in America today and their magazines.” In their reply brief to the Supreme Court in Barnett v. Raoul, attorneys for Federal Firearms Licensees of Illinois, Guns Save Life, and the National Shooting Sports Association offered a compelling argument in support of SCOTUS taking up the Illinois gun and magazine ban lawsuits now, rather than waiting for the Seventh Circuit to issue a final judgment about the prohibitions. The state of Alabama tends to be viewed as pretty pro-gun, and for perfectly valid reasons. Among others, they’re a constitutional carry state. That tends to run along the lines of there being little to no state gun control. As such, the state’s native anti-gun jihadists tend to have a lot of disappointment in their lives. But right now, they have something to celebrate. It seems the Alabama House has passed a gun control measure. Yes, really. The House passed HB36 Tuesday, which would criminalize the possession of any parts that convert firearms into machine guns. The bill passed by a vote of 60 to 38. Authored by Rep. Phillip Ensler, D-Montgomery, the bill defines a machine gun as “any firearm that shoots, is designed or intended to shoot, or can be readily restored to shoot more than one shot automatically without manual reloading and by a single function of the trigger.” Upon first violation of the bill, a person would be subject to a minimum of 100 hours of community service. A second or subsequent violation would be considered a Class C felony. The legislation would not apply to state or local law enforcement officers acting under the law, or to machine guns owned legally under federal law. “I’ve heard from law enforcement all throughout the state how much of a need there is for this,” Ensler said on the House floor. “The Alabama Law Enforcement Agency, the Fraternal Order of Police, district attorneys and the sheriffs all wholeheartedly endorse and support this bill. So, this is opportunity to support them in the work that they do.” Ensler spoke about Glock switches, also known as trigger activators, which would be banned upon the bill’s signing into law. Currently a person can be charged with possession of a trigger activator at the federal level, but there is no crime for possession or use of the part at the state level. Continued ⬇️⬇️⬇️
Whenever I see Colorado Gov. Jared Polis described as a “libertarian” or a Democrat with “libertarian leanings”, I can’t help but roll my eyes. To be sure, Polis isn’t the Rocky Mountain version of Bernie Sanders, but no self-respecting libertarian would ever sign a privacy-destroying bill like this. A new law in Colorado will track firearm and ammunition purchases across payment networks, a move gun reform advocates say will help track suspicious purchases that could precede a mass shooting. Gov. Jared Polis signed the bill into law on Wednesday. It requires card payment companies to apply a specific code to gun and ammo transactions in the state — something already done for other retailers, like grocery stores or gas stations. ... Under the new law, payment companies must make the firearm code available on or after Sept. 1. On May 1, 2025, the codes would be assigned and could then be tracked. Violations carry a civil penalty of up to $10,000 each. Rocky Mountain Gun Owners has vowed to wage legal challenges against some of the gun bills advancing in the legislature this session. But as FOX31’s Gabrielle Franklin has reported, opponents have said they probably will not pursue legal action against this measure. A libertarian governor might have brought up the fact that the folks running credit card companies have said that applying merchant category codes to gun stores is a waste of time. Former Visa CEO Al Kelly dismissed the idea when talking to Time magazine last year, arguing that the companies “don’t collect [that level of data] for consumers.” Continued ⬇️⬇️⬇️

A serendipitous discovery of a pretty astounding #photographer who went by the moniker #Weegee, and was a pioneer of #tabloid #photojournalism. In the latter half of his career he started producing #caricatures of prominent people by employing various techniques when developing the negative, like this one of Marilyn Monroe. As I was going through his work, it became evident that not only was he having fun with his experiments, he was in fact characterising the subjects of their supposed popularity by distorting some aspect of their persona. I’ve been baffled by the number of teachers who came out against the bill in Tennessee that sought to allow some teachers to be armed. After all, the bill requires school board permission and an extensive training course before you can take a gun into a classroom lawfully, so it’s not like every teacher is going to start “packing heat” or anything. But teachers don’t seem to trust either themselves, their colleagues, or both very far. They’ve been very vocal in their opposition—and I can’t help but hope their lack of trust in one another comes up the next time they’re demanding a pay raise. They didn’t want the bill to become law, yet thanks to the stroke of Gov. Bill Lee’s pen, they get to start learning how to deal with their disappointment. Gov. Bill Lee signed into law Friday a controversial bill to allow school teachers and staff to carry guns in school. The law goes into immediate effect. House and Senate Republicans passed the bill, HB 1202/SB 1321, in the final weeks of the legislative session over the protests of school shooting survivors, teachers and gun-reform advocates. Parents and most school staff will not be told who in the school has a weapon or where it might be stored. There are no safe storage requirements in the bill, and House Republicans in late April voted down a Democratic effort to codify them in the bill. Probably because what Democrats would consider “safe storage” would mean they couldn’t be accessed in case of an emergency. Well, it’s hopefully the final pitch. If the Supreme Court turns away the cert petitions in the almost half-dozen challenges to Illinois’ gun and magazine ban, the lawsuits will still continue to wind their way through the lower courts, but it could be years before they once again reach the High Court. In the meantime we’re likely to see further misreadings or outright disregard for what justices had to say about determining the constitutionality of gun control laws in its Bruen decision. The cert petitions were filed back in February, after the Seventh Circuit Court of Appeals rejected a request for an injunction against Illinois’s gun and magazine ban. In their decision, the Seventh Circuit panel bizarrely concluded that AR-15s and other semi-automatic firearms labeled by the state as “assault weapons” are not protected by the Second Amendment because they’re “like” machine guns. The panel also decided that “especially dangerous weapons” can be banned even if they’re commonly owned, so long as the government claims the bans are necessary to “protect communities”. As the Second Amendment Foundation, Firearms Policy Coalition, Illinois State Rifle Association, and several individual plaintiffs argue in their response brief to SCOTUS, “the banned firearms and magazines are beyond doubt ‘bearable arms’ that are ‘in common use’, and applying the Courts’ “text, history, and tradition” test to the Protect Illinois Communities Act must result in the gun ban being struck down. Further delay will only give lower courts more of an opportunity to continue disregarding what the justices have had to say about the scope of our Second Amendment rights. Continued ⬇️⬇️⬇️

Georgia Gov. Brian Kemp has signed into law HB 1018, the Second Amendment Privacy Act. This NSSF-supported law protects the privacy and sensitive financial information of people purchasing firearms and ammunition in the Peach State. With Georgia, there are now 14 states with laws that protect the Second Amendment financial privacy of their citizens. The law prohibits financial institutions from requiring the use of a firearm code, also known as a Merchant Category Code (MCC), from being assigned to firearm and ammunition purchases at retail when using a credit card. The law also forbids discriminating against a firearm retailer as a result of the assigned or non-assignment of a firearm code and disclosing the protected financial information. Additionally, the law prohibits keeping or causing to be kept any list, record or registry of private firearm ownership. “Governor Brian Kemp’s signature on the Second Amendment Privacy Act is yet another example of his firm commitment to protecting the Second Amendment rights of all Georgians. Citizens in Georgia won’t worry that ‘woke’ Wall Street banks, credit card companies and payment processors will collude with government entities to spy on their private finances to illegally place them on gun control watchlists,” said Lawrence G. Keane, NSSF Senior Vice President & General Counsel. “NSSF is grateful House Speaker Jon Burns, Lieutenant Governor Burt Jones, Representative Jason Ridley and state Senator Carden Summers for bringing this crucial legislation to become law. No American should fear being placed on a government watchlist simply for exercising their Constitutionally protected rights to keep and bear arms.” Georgia joins a growing list of states that are standing against the invasion of financial privacy when exercising Second Amendment rights, including Tennessee, Iowa, Kentucky, Wyoming, Indiana, Utah, Florida, Idaho, Mississippi, Montana, North Dakota, Texas and West Virginia. In particular, the definition seems straightforward but is actually pretty vague. After all, how do you determine whether something was sold at a profit or not? What’s the definition for that? I mean, if I buy a gun today and increases in value tomorrow and I sell it at fair market value, was I seeking a profit or did I just get lucky? Does the ATF look at inflation-adjusted prices or just raw dollars? There’s a lot of ways this can trip people up. And it doesn’t help when people who should know better end up trying to defend this rule as it is. That’s what one local attorney did when he spoke with his local TV station about the rule. Under the new rule, businesses subject to background checks due to their status as federal firearms licensees remain largely unaffected. However, legal experts suggest that the latest regulation intends to prompt private citizens to exercise greater vigilance regarding who they sell their guns to. Grant Wille, a criminal defense attorney at Ralls & Wille in Tucson, shared insights on the purpose of the rule stating “The purpose of this rule, as far as I can tell, is just asking gun owners to be a little more responsible.” How? On Thursday, I wrote about a case out of the UK where a drug operation had a number of guns, one of which was used on another person. It was mostly just another example of how UK gun laws don’t really work as well as some might believe. I fully intended for that to be the last I looked at for a while. It’s not so much that there isn’t gun crime in the UK, only that we don’t often see a whole lot of it in our news feeds on this side of the Atlantic. That’s especially true with how Google works, and not necessarily only because of their anti-gun bias. But when a massive example of gun control failure drops in my lap, well, what’s a guy to do? A crime gang responsible for the biggest gun running plot ever countered by UK law enforcement operated its main stash house from a plush Ancoats residential development. A property in the Cotton Field Wharf plot at Ancoats Marina was rented out to store guns, ammunition, drugs and ‘vast’ amounts of cash. Adrian Gonzalez, 33, the gangster in charge of the stash house, has now been jailed for 25 years. The gang’s ringleader, Omar Malik, was previously jailed for 38 years while four other conspirators were also handed lengthy prison sentences. A judge at Manchester Crown Court said the gang were responsible for criminality on an ‘exceptional scale’. They were behind the supply of cocaine worth £70m, and sold 48 Skorpion machine pistols to other gangsters across the UK and Ireland. “This trade in guns and ammunition, Mr Gonzalez, was described by an expert in this field as being amongst the very highest level of criminal firearm trafficking ever encountered by law enforcement in the United Kingdom,” Judge John Potter told Gonzalez, who he labelled a ‘determined’ and ‘professional criminal’. “You proved willing to be active in a trade, which on any view, causes misery to many within our communities. You knew and appreciated this harm arising from your actions. You were inspired by nothing more than greed and selfishness, in my judgement, to sacrifice the welfare of countless others, with a view to make you very rich indeed.” Continued ⬇️⬇️⬇️
