Gun owners in CA recently had a win back in August of 2020 when the 9th Circuit 3 judge panel agreed with Judge Benitez's ruling on magazine capacity limits being unconstitutional. BUT, today, the 9th Circuit vacated that ruling from the 3 judge panel and decided to hear the Duncan v. Becerra case en banc. Definition: en banc (on bonk) French for "in the bench," it signifies a decision by the full court of all the appeals judges in jurisdictions where there is more than one three- or four-judge panel. 𝗗𝘂𝗻𝗰𝗮𝗻 𝘃. 𝗕𝗲𝗰𝗲𝗿𝗿𝗮 𝗨𝗽𝗱𝗮𝘁𝗲 Today, a 3 judge panel of the 9th Circuit Court of Appeals affirmed (by a 2-1 vote) a federal district court's ruling that so-called "large capacity" magazines are protected by the Second Amendment. Every time a court recognizes infringements on the 2A is an important win for America, so we are thankful for that. It is likely that Becerra will petition the 9th Circuit for an en banc review. This means the case would be re-heard by 11 9th Circuit judges (Chief Judge Thomas who is anti-2A, and 10 others selected at random) at some future date. Many people are asking "𝗖𝗮𝗻 𝗜 𝗹𝗲𝗴𝗮𝗹𝗹𝘆 𝗯𝘂𝘆 𝗺𝗮𝗴𝘀 𝗻𝗼𝘄?" We do not believe so (at least not yet), and there are many posts in social media and in headlines that are confusing the matter and making assumptions (remember, many of these people are NOT 2A attorneys). The judge who wrote the opinion stated "We AFFIRM the district court’s grant of summary judgment for plaintiffs-appellees." We believe that means that the lower court's judgement stands. AND, it would seem that Judge Benitez would have to lift his own stay to allow sales to re-commence (similar to "freedom week" 3/26/19 to 5pm 4/5/19). BUT many think it is more likely that the status quo will remain for now knowing that Becerra will likely petition for an en banc review. These things happen so fast and are confusing, so keep your eyes and ears open. Many gun stores mentioned today on social media they are doing their best to ramp up inventory.
