The attorneys of Officer Terrence Sutton and Lt. Andrew Zabavsky filed four motions appealing the guilty verdicts, running nearly 150 pages. In the motions, their lawyers object to everything from Karon Hylton-Brown’s mother, Karen Hylton, being present in the courtroom to alleged deceitfulness from prosecutors. In one argument, Sutton’s lawyer Michael Hannon claims Sutton never engaged in a vehicle pursuit. To support his claim, Hannon cites a definition of a pursuit, as “an attempt … to apprehend a fleeing felon while in an authorized emergency vehicle with all emergency warnings [sic] devices activated.” Hylton-Brown was not a “fleeing felon” and Sutton only used his emergency equipment sporadically throughout the three-minute chase. His lights and siren were not activated in the final seconds leading up to the collision. “Hence, no rational jury could find that Ofc. Sutton was engaged in a vehicular pursuit under MPD General Policy because he did neither of these two things which define a pursuit,” Hannon writes. The incident took place on the afternoon of September 29 and Eliyas was at his Sultan Bathery residence when he received a call from the Meenangadi police. The inspector on the line asked him to urgently pay a fine for over-speeding on the highway. A puzzled Eliyas replied that his car, a three-year-old Innova, had gone for servicing and that he was at home. He then politely asked the cop to charge a fine from the man who was over-speeding, instead of asking him. Things took a dramatic turn right after this phone call, as Eliyas realised that his car had been stolen from the service centre, and the man who was driving his car was a thief, who was possibly over-speeding to dash out of the state. CCTV visuals from the service centre on the highway show the thief sneakily driving away the Innova at 12:40 pm on Tuesday. “The thief had been stopped by the interceptor car for speeding at Krishnagiri. But he escaped and then the police got the vehicle details and rang me. Immediately after they hung up, I called the inspector and informed him that the car was stolen. Alerts were then sent to all neighbourhood police stations to track down the vehicle,” Eliyas told TNM. The Bathery native knew that there were several routes to Karnataka and Tamil Nadu from the Wayanad border and therefore, tracking down the vehicle without police intelligence would be a challenge. Soon after a complaint was filed, Eliyas, his son and his office staff took Eliyas’s other vehicle - a Ford Ecosport - and drove around in search of the Innova. As they reached Matappara rocks near Ambalavayal, they spotted the Red Innova darting past them on the opposite side of the highway. This is when Eliyas swiftly stopped, reversed the vehicle and was hot on the wheels of the man who stole his car. Within five kilometres, the thief drove into a pocket road, to possibly use a non-highway route. #VehicleChase that started in North Highlands went all over North Sacramento County and Placer County on and off the Freeway then the car ended up crashing at Marysville Rd and West El Camino. Unknown reason it was being chased by #SacramentoSheriff Time of Chase 35 minutes. It started around 3:45 AM. Was awoken by sirens.
So this was supposed to be a very normal day. Woke up at 6, did my chores and I decided to go to office early. Waiting for my usual bus, when it arrived I realised it's packed and I rather take the auto which has been parked on the side for the longest time. He said 40, I said Aye. Stuck in the normal bangalore traffic, the auto crawls like a snail through it all. And then a police man in the middle of the road indicates us to move to the left behind an auto, we move to the side and VROOM. My auto guy gets into the ONLY chase I have been in. An auto and police bike chase. So if the need arises any snail can find its way through the Bangalore traffic and zoom past it. We cut through half the Bangalore traffic within a min and took a sharp left turn into a galli, almost getting killed by a truck. The police moves past through us and screams some loud kanada gaalii when he realises that he lost us! We park at the dead end of the galli for 10 mins and then sneak back into the road to drop me to work. I asked Ab Kitna?
