The Āimmah of Najd said: “It is necessarily known from the religion of Islam that there is no religion without a Jama’āh [community], and there is no Jama’āh [community] without an Imam [ruler] and there is no Imam [ruler] except with hearing and obeying and that rebelling from obedience to the ruler and issuing fatawa against him [inciting the people against him] is from one of the greatest causes of corruption in the Land and for the subjects. It is turning away from the path of guidance. Allah the Almighty says: ‘Indeed, Allah commands you to return trusts to their rightful owners; and when you judge between people, judge with fairness. What a noble commandment from Allah to you! Surely Allah is All-Hearing, All-Seeing. O believers! Obey Allah and obey the Messenger and those in authority among you. Should you disagree on anything, then refer it to Allah and His Messenger, if you ˹truly˺ believe in Allah and the Last Day. This is the best and fairest resolution.’ سورة النساء ٥٨-٥٩ Shaykh Al-Islam Ibn Taymiyyah said about this Ayah in ‘Kitaab As-Siyassah Ash-Shar’īyyah’: ‘The scholars said, The first Ayah was revealed about those in authority [rulers], that they must deliver the Amanah [upon them] to their people and if they rule between the people, they must rule with justice. Shaykh Sulaymān Bin Saḥmān [1349H] wrote, after mentioning the story of the emergence of the Khārijites, citing from Shaykh ʿAbd Al-Laṭīf Bin ʿAbd Al-Raḥmān Bin Ḥasan [1293H], the great grandson of Shaykh Muḥammad Bin ʿAbd Al-Wahhāb: “This is a summary of their affair and you have come to know their misconception on account of which they firmly held the disbelief of ʿAlī and his party and Muʿāwiyah and his party. This belief remained present amongst those who had dispersed after this event. The extremists amongst them then began to make takfīr by way of major sins. Then they gained strength and [acquired a] state after which they were fought by Al-Muhallab Bin Abī Ṣufrah, Al-Ḥajjāj Bin Yūsuf. And before that, they were fought by Ibn Al-Zubayr during the era of his brother, ʿAbdullāh. It was then spread about them, that they make takfīr by way of sins, meaning those which are less than shirk. End what was mentioned by our Shaykh [ʿAbd al-Laṭīf]. [Shaykh Sulaymān bin Saḥmān], When they had such exaggeration in religion and exceeding the limit which they had been commanded [to remain within], they declared Muʿāwiyah and whoever was with him from the Companions to be disbelievers and they declared ʿAlī Bin Abī Ṭālib, the chief of the believers, and whoever was with him from the most superior among the Companions and Successors to be disbelievers when they agreed with them [the party of Muʿāwiyah] to set up an arbitration. They claimed that allowing men to judge in Allāh’s religion is disbelief that expels from the religion. They said that they had sinned on account of this [by agreeing to it at the beginning] and had disbelieved. In fact, when Imam Ahmad Bin Hanbal was asked about a person who fasted, prayed and secluded himself In the mosque for worship, if he was dearer to him than a person who spoke out against Ahl Al-Bīd’āh, He replied, ‘When he fasts, prays and secludes himself, then he does so for the benefit of his own self However when he speaks out against the innovators, He does so for the benefit of the Muslims In general, and thus Is more virtuous.’ So It Is clear that openly opposing the innovators is of general benefit to the Muslims and is considered one of the types of Jihad in the path of Allah, Since purifying the religion of Allah and defending It from their attacks Is a collective obligation as is agreed upon by the Scholars. For if Allah did not raise up some people to oppose the innovators, then the religion would suffer harm, corruption and deviation. Indeed, this type of corruption Is even greater then the corruption resulting from the disbelievers conquering the Muslims. Since when the disbelievers conquer the Muslims, they do not corrupt their hearts, nor their religion, except after some time. Shaykh Al-Islam Taqī Ad-Dīn Ahmad Ibn Taymiyyah رحمه الله رحمة واسعة said: “As for when the judgement of a ruler is intended by [the term] Al-Shar’ [the legislation], then he could be oppressive, and he could be just, and he could be correct, or he could be in error. Evidences are sought from the Book and the Sunnah for the statements of Ash-Shafī’ī, Ahmad, Ishaq, Dawud and others, and when a person blindly follows another person, [in the situation] that is permitted for him, then it is permissible. Meaning, that the following [ittibaa] of one of them is not obligatory upon the whole Ummah just like the following [ittibaa] of the Messenger ﷺ [is obligatory upon the whole Ummah]. And nor is Taqlīd of one of them prohibited in the same manner as following [ittibaa] the one who speaks without knowledge [is prohibited]. And as for whatever a person ascribes to the Shari’āh that is not from it, such as the fabricated Ahādiths, or interpolating [ta’awwul] the texts in a way that opposes the desired intent of Allah, and other such things, then this is a form of Tabdil [altering, changing]. In every age, there has been a noble company of scholars who stood firm and expended great efforts in defending the Book of Allaah and Sunnah of His Messenger ﷺ and in refuting the people of innovated beliefs, innovation, deviation and misguidance. At the head of them towards the end of the third century and the beginning of the fourth was the Imaam who aided the Sunnah and subdued innovation: Abu Muhammad al-Hasan ibn ‘Alee al-Barbahaaree. The author, Imaam al-Barbahaaree (d.329H), was a prominent scholar of his time. Yet he still opposed whatever they innovated of false statements, since that was major disbelief, even if they did not know it. He would oppose it and strive to refute it with whatever was possible. Shaykh Al-Islam Taqī Ad-Dīn Ahmad Ibn Taymiyyah رحمه الله رحمة واسعة said: “When he accepts the condition in the marriage contract that he will not marry another wife against her will, if he marries another wife, the matter is in her hands. This condition is valid and required in the school of Malik, Ahmad, and others. Whenever he marries another wife against her will, the matter is in her hands.
