Can you grant a license without the owners' corporation's authorisation if you have an exclusive area connected to your lot? Typically, lot owners include the exclusive area in the lease. An exclusive use by-law gives exclusive rights to a common area, similar to a lease. The benefiting owner has exclusive use of the area, subject to conditions, excluding others. If the by-law doesn't restrict licensing or require consent for subleasing, the lot owner can license the area. It's rare for the by-law to cover rights assignment. This is really the truth of it.....leave yourself time to consider the details. Especially if you are a women investing in property for the first time. An industry that provokes the deepest impulses of FOMO is property investment. It completely runs off scarcity and making you feel like you are going to miss out. It's based on speculation, but at what cost? Especially if it's not the best investment but you are worried about the pressure to complete the sale. I am all for wealth through property but I am also against the macho property stereotypes that keep women in the shade and out of the arena. Alot of women my age or older don't have property or feel they missed out because they left it to the men in their lives to deal with. Or they felt they didn't have the skills to partake in property dealings. I worry for these women because we earn less in most jobs compared to our male counterparts, we have time away from employment to raise children and we don't always learn how to be money and property savvy like men do. It's for this reason I want to help women invest safely because usually we have the most to loose. Lower borrowing capacity, less earning and so on. Let's change this from the inside out. We can do it! And support each other gain wealth and show our daughters we can do and so can they!

Firstly, it's always good to get repairs done quickly to avoid further damage, and doing so will not be prejudicial to your claim. Secondly, a builder might be able to find evidence about the damage that contradicts the insurance company's expert witness. If there are serious defects in the common areas of your apartment complex (in buildings less than six years old), Project Intervene may be able to get these fixed at no cost to the owners corporation, by facilitating an agreement with the developer/builder. ๐ŸŒฑ When strata funds are in surplus, committee members of the owners corporation have a duty to make sure that the capital saved by owners is well managed - balancing risk with rewards. This means choosing a suitable investment mix, within a timeframe that matches the scheme's projected spending. Keeping large balances in non-interest earning accounts for long periods would reduce their worth due to inflation, which is not a wise management choice. On the other hand, investing in high-risk schemes is also not prudent. โ˜€๏ธ If you live in an apartment, you may think that it's not possible to get solar. Limited roof space, shared ownership of common property and strata limitations can make thing more difficult, but you do have a few options: 1. Solar sharing In apartment buildings, decisions about common property are made by the owners corporation, and not everyone wishes to invest in solar. Owners who want to install their own system would also need approval from the owners corporation to use part of the common area (i.e. the roof). This gets more complicated if multiple residents wish to do the same thing, with various panels and cables having to be accommodated. One solution to this issue is to use a solar sharing gateway. This is a single solar system that can be shared between multiple residents via a solar splitter. So those residents that want to participate can share the cost and enjoy the savings. 2. Community solar gardens If you just can't go solar in your own building, you can participate in a community solar garden. This is a large-scale, grid-connected installation that allows multiple buildings to share the benefits of solar energy without having to put panels on their own roof. 3. GreenPower If you are keen on renewable energy for environmental reasons, then a third alternative is GreenPower, whereby energy retailers offset customersโ€™ power usage by purchasing electricity through accredited renewable generators. The extra cost of GreenPower, however, is passed onto the consumer. The best path to solar for each apartment owner depends on their individual circumstances. While there are no limitations on the rate or frequency of strata levy increases, the legislation does set out the process for raising a levy, which in normal circumstances will usually ensure that these are not unreasonable. Levies are decided on at a general meeting and must be discussed and accepted by a vote of the owners. Annual levies are determined at the AGM each year, and special levies can be decided on at the AGM or an Extraordinary General Meeting.. You can vote against the increase or put up a motion for a different levy amount if you wish. Levies are normally only increased if there is a need to do new works or there are additional expenses. Ask why the increase is being made if you are not sure. ๐Ÿ• 61% of Australian households have a pet in the family, and there's no doubt their companionship has been invaluable over the last few years. ๐Ÿˆ In August 2021, there was a shift in NSW Government policy to encourage pets in strata buildings. By-laws that apply a blanket ban on pets, and decisions by owners corporations to prohibit the keeping of a pet, now have no force or effect - unless it can be demonstrated that the pet in question would unreasonably interfere with another occupantโ€™s use and enjoyment of their lot or common property. ๐Ÿฉ Many owners corporations have now moved away from โ€œno petsโ€ by-laws to by-laws that regulate pets. These typically require an owner or occupier to first seek the permission of the owners corporation. But some of these by-laws also deem it to be reasonable to reject a pet application in certain circumstances, e.g. - keeping more than one pet - keeping a certain type of animal or - keeping a medium or large sized dog. Any owners corporation that simply relies on such by-law provisions to reject a pet application will likely fall into a trap. Rather than banning the animal, they will unintentionally make a decision that has no force or effect - and therefore confer permission for the pet owner to keep the animal in the building. How should a strata committee approach requests by tenants to store items in common areas - such as leaving bikes or strollers in the space under the stairs? ๐Ÿšฒ These requests can raise concerns about fire safety as well as equity. If there is only limited space, which tenant has the right to to use it? This is not an uncommon problem. ๐Ÿ  If you live in a secure gated community, there might be some owners who want the gate to remain open during the day, and others preferring to keep it shut. To resolve this, first check your by-laws. For security, you may have a requirement that all gates and doors are kept closed except when in use. If most owners would rather keep the gates open during the day, you would need to amend this by-law - and if there is no such by-law, you should create one via special resolution. โ“ Whose insurance covers internal walls and built-in furniture in a strata apartment? ๐Ÿ˜ Internal walls (that are not temporary) are covered by strata insurance as part of the building. But note that paint and wallpaper are excluded by certain policies. Furniture which is permanently affixed to the building and cannot be removed at the end of occupancy can be considered covered by strata insurance. To avoid doubt, the owner should check with their strata insurer that the furniture is covered, or consider factoring any built-in furniture into their contents insurance instead. In general, if you have strata insurance and contents insurance with a reputable insurer, between the two policies all items in the lot (excluding vehicles), should be covered. Generally, if a strata title, body corporate, or owners' corporation is only responsible for common areas used only for residential purposes, it is not a person conducting a business or undertaking in relation to the common areas and so is excluded from the PCBU duties under work health and safety laws. However, this changes if the body corporate employs a worker or the Strata Licensee employs a person to carry out work in the common areas on behalf of the company. Usually too, if common areas are used as mix of residential and commercial purposes, work health and safety laws will apply. How do Strata Companies ensure they are meeting their PCBU obligations under work health and safety laws??
