Summer can’t come soon enough! So many artists and bands to see in concert… but it’s tough deciding if I want to spend the money to go to the Simple Plan, X Ambassadors, and/or P!nk concerts or not. O Decreto-Lei nº 911/1969 prevê que, havendo uma venda prematura do bem pelo credor fiduciário após a busca e apreensão e essa busca e apreensão venha a ser julgada improcedente, o credor ficará obrigado a pagar uma multa de 50% do valor do bem atualizado do objeto do contrato de alienação fiduciária. A Terceira Turma do Superior Tribunal de Justiça (STJ) decidiu recentemente que a referida multa não é aplicável quando a sentença da busca e apreensão improcedente em primeiro grau for revertida no tribunal competente. No caso em questão, um banco ajuizou busca e apreensão para reaver veículo de fiduciante que não honrou o pagamento. Após a tomada do veículo, o devedor quitou as parcelas, o que levou a busca e apreensão a ser julgada improcedente, com a condenação do banco a pagar a multa de 50% prevista no Decreto-Lei nº 911/1969. O veículo, contudo, já havia sido alienado para outrem pelo banco fiduciário. Na análise do recurso, o tribunal entendeu por bem reverter a sentença e reconhecer a procedência da ação, consignando que ao quitar os pagamentos o devedor reconheceu implicitamente a procedência da ação. O acórdão, contudo, manteve a multa em razão da venda prematura do bem pelo banco. No STJ a multa foi derrubada. O relator do recurso, ministro Marco Aurélio Bellizze, ressaltou que a multa em questão tem como finalidade recompor prejuízos do devedor fiduciante em razão da venda prematura do bem decorrente de ação de busca e apreensão indevidamente ajuizada. No entendimento do relator, a multa deve ser aplicada quando presentes dois requisitos cumulativos, quais sejam a sentença de improcedência da ação de busca e apreensão e a venda prematura do bem. No caso em tela, entendeu-se que em razão da reversão da sentença de improcedência foi revertida no segundo grau, a multa não deveria ser aplicada. #AJR #direitocivil #stj
