This eeoc guidance on how to handle employees with COVID is terrible. Everyone is going to get sued. Every single paragraph is contradictory. This recent EEOC guidance is awful for employers. Way too many contradictory rules, overlap, and almost impossible to apply. I will be providing my thoughts and comments over the next few days, which will be available to all on my website in the "Unusally Motivated" section. If any employers run into issues with understanding COVID restrictions, vaccines or dealing with accommodations, please feel free to reach out to me. I will leave you with this-- contrary to the media's narrative, you will not simply be able to mandate testing and vaccines without risk. Wojtaszek, ruled against the 25% capacity limit, and permitted the Gym to operate at 100% -- While the Judge reserved the decision for some point in February 2021 to argue the merits, this is a good example of why you need to fight this sort of tyranny. If you do not fight, you will just have your rights diluted and ultimately wiped out. Everyone—just a brief reminder on the regulations for the Department of Health and the COVID-19 Emergency Regulations. . 1. They shall only apply for the duration of the “state of emergency” disaster. They are NOT legislative laws. The are temporary. See Sec. 66-3.1 . 2. There is no rule or requirement of what a “face covering” is—it is broad and can be anything, including a napkin. See Sec. 66-3.2(e)(ii). It just needs to cover the “nose and mouth”. See Sec. 66-3.2(a). . 3. You are ONLY REQUIRED to wear a face mask when all 4 elements are met (a) you are in a PUBLIC PLACE, (b) you are UNABLE TO MAINTAIN SOCIAL DISTANCING, you are (c) OVER THE AGE OF 2, and (d) you are able to MEDICALLY TOLERATE. If any of these 4 items are missing, you do not need to wear a face mask in a public place. . 4. A business operator, who doesn’t comply with this section (meanwhile it speaks of public places, not private places, like private businesses), can deny admittance BUT must do it in a way that respects the ADA and Human Rights Law. Again, for businesses, YOU DO NOT NEED TO TURN THEM AWAY IF THEY TELL YOU THEY HAVE A RESPIRATORY PROBLEM. Do not turn away the money! See Sec. 66-3.d. . 5. Finally, do not let them scare you.. the penalties will NOT be $15,000 automatically. Entities (business) are subject to a maximum fine of $1,000 per violation. The maximum fine of $15,000 is for those who (a) have gathering of greater than 10 people, or (b) encourage gatherings of greater than 10 people. A SMALL BUSINESS IN A NEIGHBORHOOD BODEGA OR GROCERY STORY WILL NOT RUN THIS RISK. .
