My clients experienced a sale fail on this home. We discovered during contract writing that our offer being accepted was contingent upon the seller’s replacement property appraising. Information that was not disclosed up front. Knowing this information, we wanted to protect them in the ways we could while still proceeding with an offer. I consulted my clients that we write into our offer for the inspection period to not start till X date, till we heard back about the seller’s replacement property appraisal. This protected my clients financially, not having to pay a fee out of pocket with the chance of the sale not going through. The timeline to hear back from the seller’s would be before we had to proceed with paying for their appraisal. Title companies generally absorb costs when sales fail as those costs would be rolled into closing costs. In this case, our title company absorbed the sunken costs. My clients were willing to wait 2.5 weeks while we saw the seller’s contingency through. In the end, the seller’s replacement home did not appraise, our contract was terminated, and my clients received their full earnest money back. Each real estate transaction is unique and presents its own set of circumstances. We learned we likely won’t offer on a contingent home again.
