Yesterday was a big day for us, and a big day for Malachy. He’s doing an internship with us through his school. Yesterday was his first day- and he hit a home run!!!! After about an hour of training, we asked if he wanted to try alone. Without hesitation, he said yes! He worked hard, got along w his coworkers, laughed, and even threw in a little air guitar for us! Which means he is now “one of us”! We are so excited to have him as an intern and look forward to watching him grow and learn new kitchen skills! Let’s give him a big 👍!

Changes are coming for the right to request flexible working... do you know them? The Employment Relations (Flexible Working) Act 2023 & Flexible Working (Amendment) Regulations 2023 came into force 6 April 2024. The changes mean that: The right to request flexible working will become a day one right (there will no longer be a requirement for a qualifying period of 26 weeks continuous employment). Employees will no longer have to explain what effect their requested change may have on the employer and how any such effect might be dealt with. Employees will be entitled to make two requests (instead of one) in any 12-month period. Employers will not be able to refuse a request unless the employee has been consulted. Employers will have to make a decision in two months (reduced from three months), subject to agreeing a longer decision period. How does holiday entitlement work in April 2024? Whether you are an employee or employer the new Employment Rights Regulations 2023 could be affecting you. What are the changes? Essentially, for leave years beginning on or after April 1, 2024, holiday entitlement for irregular-hours and part-year workers will be calculated in hours, not weeks. It will accrue at the rate of 12.07% of the hours worked in a pay period, this figure is based on the statutory minimum holiday entitlement (5.6 weeks). For workers who are on sick leave or statutory leave, holiday entitlement will be calculated by reference to a 52-week reference period. This will allow employers to review and work out an average of hours worked across that period, to inform what period of leave should be deemed to have accrued during the period of absence. FWC upholds termination of employee for submitting false work times: The Fair Work Commission has dismissed an unfair dismissal application from a female traffic controller, found to have falsely claimed work times when she was not present on her allocated worksites. The worker, ‘JB’, had been employed by Verifact Traffic Control Pty Ltd (“Verifact”) as a Traffic Controller since December 2018 until her dismissal on 22 December 2021 following an investigation that identified discrepancies in the recording of her shift data. JB contended before Deputy President Nicholas Lake that the penalty of termination was harsh, that there were flaws in the investigation, and that she was not afforded procedural fairness. Verifact uses a data capture system, ‘Traffio’, where a work docket is prepared and electronically generated, the start and finish times are recorded and signed off by the employee’s Supervisor, and then the client signs the approval for the job at the end of the job. The company issued two notices in the period prior to JB’s dismissal to all employees regarding the importance of employees accurately recording their dockets. On 4 November 2021, JB was identified leaving a site two and a half hours earlier than what was recorded on the docket as the finish time. She claimed that a client had requested her to travel to another site, although no record was made on the Traffio system. High Court Affirms Employees’ Workplace Rights: In a significant decision, a full bench of the High Court has determined that Qantas took adverse action against a group of employees after making the decision to outsource their work. The ruling confirms that adverse action can occur even before the exercise of a workplace right. As noted in the lead judgement, “In short, a person takes adverse action against another person for a substantial and operative reason of preventing the exercise of a workplace right by the other person contravenes s340(1)(b), regardless of whether that other person has the relevant workplace right at the time the adverse action is taken”. The appeal judgement centred upon the decision of Qantas in 2020 to outsource their ground handling operations, consisting of ramp, baggage and fleet presentation work, including baggage handling and aircraft cleaning. Suffering a significant downturn in revenue during the COVID-19 pandemic, Qantas contemplated extending the outsourcing of the work to third-party contractors for all of its airport operations, which comprised ten remaining airports. Initially, Qantas notified the existing employees of the likely change and offered them the opportunity to submit an in-house bid template to maintain the work for a further five-year period. However, the bid was less competitive than outsourcing.
