Service charges have become a hot-button issue across the country, and the only people that seem to be happy about it are restaurant owners. Customers don’t want to pay arbitrary fees. Front-of-house workers question whether the mandatory service charges eat into their tips. Back-of-house workers wonder how the charges can be tracked on their paychecks, or if they’re getting them at all. Hi y’all! I wish I had some good news to share but unfortunately that is still not the case. Despite repeated efforts, Stephon and I have been unable to secure new employment here in Vietnam for short-term due to work visa regulations. We are now behind on our rent and are struggling to see how we can afford any basic living expenses after the next few weeks. This whole situation is just hopeless and dehumanizing and has left my whole family at risk in a foreign country. (GoFundMe link 🔗 in bio) Additionally, we are struggling to support our beloved pets during this transition and challenging situation. Our elderly dog Dora is terminally ill with multiple failing organs and has needed for several months now to be put to sleep humanely, as she cannot survive her condition much longer and is in considerable pain. Our young cat Oreo will likely be unable to join us in our move without financial aid. Unfortunately, we are now having to make tougher decisions as we simply cannot afford to do most things at this time. There are also some things happening on the legal side but these will take a very long time to resolve sadly. The New York Fashion Act is a groundbreaking bill initially put forward in the 2022 New York legislative session by State Senator Alessandra Biaggi and Assembly member Dr. Anna Kelles. Make sure you're paid for all hours worked, that the clock in/out times are correct, that the tips match up, etc. And while you're there, it's time to start asking where those nebulous "service charges" are going too. Employers are under no obligation to disclose where that money ends up, and unlike tips, workers aren't automatically entitled to them. Wage Theft Enshrined in Federal Legislation. The Federal government has achieved the passing of legislation enshrining wage theft in the Fair Work Act 2009, secured on the last sitting day of Parliament for the year with the support of prominent senators David Pocock (Independent) and Jacqui Lambie (Jacqui Lambie Network). In a surprise move, the government elected to split their proposed Changing Loopholes Bill into two parts to secure the support of the cross benches. Under the legislative provisions, which passed the Parliament in late 2023, an employer convicted of 'intentional wage theft' could face up to 10 years imprisonment. The maximum fines that courts will be able to impose on a company will be three times the underpayment or 25,000 penalty units, which is currently $7,825,000. For an individual, the maximum fine is three times the underpayment or 5,000 penalty units, which is currently $1,565,000. In simple terms, 'wage theft' occurs when an employer fails to pay an employee their correct wages and entitlements under a relevant Modern Award or a prevailing enterprise bargaining agreement. The Biden administration announced a new rule Tuesday to expand overtime pay for around 4 million lower-paid salaried employees nationwide. The regulation will increase salary thresholds required to make workers exempt from overtime pay laws. The present annual threshold for salaried employees’ overtime pay is around $35,500, set by the Trump administration in 2019. Beginning on July 1, 2024, that cutoff will increase to $43,888. It will further increase to $58,656 on Jan. 1, 2025. “This rule will restore the promise to workers that if you work more than 40 hours in a week, you should be paid more for that time,” Acting US Department of Labor (DOL) Secretary Julie Su said in a statement. “Too often, lower-paid salaried workers are doing the same job as their hourly counterparts but are spending more time away from their families for no additional pay.
