Maui draws visitors just to see the colorful sand on the beaches. The red sand is made of lava rock that is cooled above the water as part of the island. Because it is exposed to open air it creates a “rust.” Kaihalulu Beach is the one that many people hope to see. Because the trail to that beach is on private land, we chose not to visit that beach. 🌺The Hawaiian tradition of Malama ka ‘aina i ke kai (take care of the land and ocean) demonstrates the deep connection Hawaiians have to the land. Throughout our trip we did our best to respect the locals and their land. 🌊Instead we stopped to see the dark red sand at Kōkī Beach. It is a beautiful beach that is not great for swimming, but is very popular with the local surfers. You can also get a good view of a small island, about a half mile offshore, called 'Ālau. This was a wonderful place to end our long day of driving and hiking. 📸 • @ikaika_daclown On this day, November 28th, Lā Kūʻokoʻa was recognized across the Kingdom of Hawaiʻi as a national holiday. Lā Kūʻokoʻa signifies the day Timoteo Haʻalilio (1808-1844) received signatures from the French, British and United States declaring Hawaiʻi a sovereign independent nation. Haʻalilio, with missionary William Richards along as his secretary, traveled through Mexico on foot and donkey to Washington D.C., where they met President John Tyler. President Tyler agreed to the intent of the proposed treaty. Haʻalilio and Richards, armed with his agreement, then went on to Europe, to Belgium, Paris, and London, where the treaty was finally signed. They returned to the United States to cement the U.S. agreement. Timoteo Haʻalilio gave his life for this journey of independence, and died while on the final leg of his voyage before returning home to his beloved Hawaii, on December 3, 1844. He was 36 years old. 📸 • @kanaeokana Does the Department of Transportation have jurisdiction over Mauna Kea Access Road? ⠀ ⠀ ⠀ ⠀ ⠀ Governor Ige acknowledged in his December 19, 2019 press conference that the Department of Hawaiian Home Lands owns Mauna Kea Access Road. He further noted that the roadway “is in the process of being transferred over to the Department of Transportation.”⠀ ⠀ Yet even without DOT ownership, the governor claimed that “the Department of Transportation has jurisdiction over the road.” A close look at HRS §264 relating to state highways calls into question the governor’s assertion. ⠀ ⠀ ⠀ ⠀ HRS §264-42 indeed gives the DOT authority to “designate for inclusion in the state highway system, such other public highways, including county highways.” And HRS §26-16 gives the DOT authority over the State Highway System. However, HRS §264-2 requires that “the ownership of all public highways and the land, real estate and property of the same shall be in the government in fee simple.” ⠀ ⠀ In other words, while the DOT can incorporate public roads into the State Highway System over which it has authority, it can only do so if the government owns the land involved.⠀ ⠀ ⠀ ⠀ ⠀ ⠀ ⠀ And although the DHHL is part of the government, its trust lands are set apart from other state owned land. The Hawaiian Homes Commission Act Section 206 states that “the powers and duties of the governor and the board of land and natural resources, in respect to lands of the State, shall not extend to lands having the status of Hawaiian home lands, except as specifically provided in this title.”⠀ ⠀ As with the governor and the Board of Land and Natural Resources, the DOT is not provided authority in the HHCA to take lands from the DHHL trust. DHHL lands are not part of the general pool of government lands but are reserved exclusively for DHHL’s trust purpose. ⠀ ⠀ ⠀ ⠀ ⠀ Without the State’s fee simple ownership of Mauna Kea Access Road, how can the DOT claim it has jurisdiction over it? How does this beautiful, but crazy diverse Island cohabitate? The Mauna doesn’t try to change the trees, flowers 🌺, birds and 🌊. The Mauna realizes it’s worth. The lava doesn’t try to be the flower or change the flower but provides nutrient dense soil where the flower and plants can grow. The ocean doesn’t complain about the different ocean life that lives within, but instead provides a powerful playground and magnificent home for many different creatures. The elements of the Island do a dance with all and each knows when to dip, swing, sway and when to stay. The Island has a lot to teach us.

There is a famous Hawaiian proverb that says "aloha mai no aloha aku, o ka huhū ka mea ola 'ole ai". It means that when love is given, love should be returned. Anger is the thing that gives no life. Love is reciprocal. True love includes two parties giving unconditional care to each other. It is a reminder that all life: newborns, new plants, and new days come from the unification of male energies and female energies. Children come from an act of love from their parents, plants come from an act of love from seed placed in the ground, and a new day starts when the sun meets the horizon. While aloha brings things together, anger drives them apart. The word huhū even implies that a person who engages in anger is departing from the proper course of behavior. True aloha is difficult. It accepts the other person where they are and understands their imperfections and misperceptions. Regardless if one acts to you in anger, Hawaiians believe it’s best to respond with love. Many Hawaiians believe that Mauna Kea is their ancestor and it is to be treated like a beloved family member. To understand this you have to understand the way that they view the concept of family. The Hawaiian word for family literally translates to “works similarly”. In ancient Hawai’i, children tended to not just look like their parents, but also inherited their characteristics and held similar professions, carrying the line of traditional knowledge passed down to them. Humans can be seen as a vessel of water, holding a steady beat resounding from our hearts. Hawaiians believe that the god Kāne is the source of all water and life. He gave the first breath and started the pulse we carry on today. Just like the mountains, we are vessels holding his gifts: water, heat, knowledge and a heartbeat. Whenever we drink, we function similarly to geological formations that can contain and transmit water. Ok...I had to shed some light on this Mana Wahine right here. @shaunalee.k (far right) is one of the main reasons I found my way into the Kapu Aloha Crew on the Mauna. I’ve known her for many years and our families spend a lot of time together. And coincidentally when we both headed up the Mauna we were there at the same time. I told her I was called up and my heart was pulling me there, but that I didn’t know how I was gonna help. I went there with an open heart and mind just knowing I was gonna step out of myself and be of service somehow. She took the liberty of talking to some of her Ohana up there and threw me right into Kapu Aloha. Since then I’ve watched her use her law degree to help our Kia’i not only on the Mauna, but at Sherwood’s and now at Kahuku. .
