Unfortunately money and the local authorities dictate the additional help my son gets instead of the legal, contributing factors that should be taken into account Stats: Did you know over 99% EHCP cases that go to tribunal get approved and passed as the child meets the criteria. 99%! What a waste of time and money taking LA to court for what your child is legally entitled to - may I add the LA end up paying for this anyway! They are hoping parents see the refusal to asses letter and think it’s then end of the road for them and their child. IT IS NOT. Fight. Fight. Fight! It’s a sorry state of affairs that the LA work to their own criteria with a very small consideration for the two very small factors a child needs to obtain an EHCP. Our decision letter was factually incorrect. Had the application even been looked at adequately? It stated documents weren’t there that were and when I questioned our SEN lead, I was greeted with ‘oh I worded it wrong’. This is my sons education and life, wording it wrong doesn’t cut it lady. They have had 30 days to arrange mediation to discuss it out of court and have failed to meet that deadline. Is it because they’re too busy? Or are they hoping I’ll leave it and try again in a few years or not at all. Over my dead body. My son WILL NOT be failing before he obtains the help he needs and is entitled to.
