After a decision from the Federal Court late last year upended Canada’s efforts to regulate plastic pollution, the legal fight is set to continue. The case is headed to the Federal Court of Appeal in the coming months, where health and environmental groups are intervening to defend the Canadian government’s ability to regulate plastic pollution to protect the environment and human health. A coalition comprised of the Canadian Association of Physicians for the Environment, David Suzuki Foundation, Environmental Defence Canada, Greenpeace Canada, and Oceana Canada, represented by lawyers from Ecojustice, has been granted leave to intervene in the appeal. Dr. Melissa Lem, family physician and president of the Canadian Association of Physicians for the Environment, said: “Plastic has become ubiquitous in our daily lives – and this is causing a serious health crisis. Each stage of plastics production, use and waste causes harm to health. Thousands of chemicals in plastics have been linked to adverse health outcomes like cancers, endocrine disruption, and reproductive harm. In this context, it is absolutely right for the Government of Canada to designate plastics as toxic to better protect human health. This morning, environmental groups held a press conference drawing attention to the health and justice harms of plastics as negotiators discuss a global plastics treaty. Representatives from the Aamjiwnaang First Nation and various environmental groups hold a news conference in Ottawa to raise concerns about health and environmental harms caused by the plastic industry in Canada. Aamjiwnaang First Nation called on the Ontario government to shut down a chemical plant in Sarnia after high levels of the cancer-causing chemical benzene were detected in the Ontario First Nation and several of its community members fell ill and were hospitalized. Speaking with reporters are Janelle Nahmabin (elected councillor, Aamjiwnaang First Nation), Dr. Sehjal Bhargava (Canadian Association of Physicians for the Environment ), Melissa Gorrie (law reform manager, Ecojustice), Sabaa Khan (climate director and director general of Quebec and Atlantic Canada, David Suzuki Foundation), and Karen Wirsig (senior program manager for plastics, Environmental Defence). One acre of healthy trees can absorb the amount of carbon dioxide created by a car driven for 41,000 Km. Plastic is not a natural product, meaning nature has no way of breaking it down. Today Americans discard about 33.6 million tons of plastic each year, but only 6.5% of it is recycled. The rest ends up in landfills where it takes thousands of years to decompose. When we throw away our plastic bottles and bags, we are contributing to the growing problem of plastic landfill. When plastics end up in landfills they are not harmless. Once plastic waste is thrown away, it can be buried deep within these landfills. This allows harmful chemicals to percolate through soil and contaminate groundwater. It breaks down into tiny toxic particles that contaminate the soil, waterways, and enters the food chain where animals accidentally ingest them. It’s important to understand the consequences of our actions and our personal role to ensure sustainable uses of resources.
