It doesn't matter what time of day it is, our enforcement agents will stay until the job is done. This week's #throwbackthursday looks at a site we attended, where even with a magistrate's warrant in place and police assistance, the unauthorised encampment still didn't want to leave. However, once we started deploying a tow truck they quickly decided it would be better to vacate the site. 🗞️Planning Legislation Update! 🏚️Planning permission is usually required for work considered ‘development’, however there are some exceptions outlined for England in the Town and Country Planning Act. One example of this includes ‘enforcement time limits’. After a period of time and under certain conditions, something that would have required planning permission could eventually be considered immune to planning enforcement. 🏗️There was a “4-year rule” that applied to particular circumstances, however as of Thursday the 25th of April this legislation will be as scrapped as one of the changes from the Levelling Up and Regeneration Act. Instead, “the ten year limit for bringing enforcement action will apply where alleged operational development was substantially completed on or after 25 April 2024, or where the date of an alleged change of use to a single dwellinghouse was on or after 25 April 2024.” 💸It’s always important to ensure that development has the right planning permission in place. This also applies when considering purchase of a new property, because having to seek retrospective planning permission can be awkward and expensive.
